What is an Expert Witness?

At Olden Property we can act as an Expert Witness where a property dispute comes before a tribunal. Our expert witness work is generally either concerned with our work in the world of Compulsory Purchase or residential Lease Extension and Freehold Purchase (collective enfranchisement) work.

We also act as an expert witness where cases are not confrontational such as a missing landlord situation where monies paid into court. A surveyors primary duty as an expert witness is not to our client but to the tribunal where our expert witness report and evidence given. When acting as an Expert Witness our evidence is:

  • independent and unbiased

  • within our expertise, experience and knowledge

  • state the main facts and assumptions our valuation is based upon

  • does not omit material facts relevant to our conclusions; and

  • is impartial and uninfluenced by those instructing us

Our most recent expert witness instruction came through a firm of solictors acting on behalf of a group of leaseholders. In this case the leaseholders applied to acquire the freehold interest in their Propert but as they were unable to contact their landlord (missing landlord) the required an expert witnes report from Olden Property.
